Employment Contracts

The employment relationship in Illinois is considered by law to be “at will”, meaning that unless the parties contract otherwise, it is presumed that employees may be terminated from employment with or without “cause” at any time. It is therefore critical that employers who desire to retain the flexibility of this “at will” relationship with their employees make certain that they neither intentionally nor inadvertently create an employment contract or employment expectation which would confer rights upon an employee to continued employment. Since certain terms of employment, including things such as duties and compensation are best memorialized in writing at the beginning of the employment relationship, these agreements must be carefully worded so as to maintain the at will relationship between the parties.
